Why Does TPD Apply to Vaping?

Although e-cigarettes and e-liquids don’t contain tobacco leaf, they’re still regulated under TPD because they contain nicotine, which is extracted from the tobacco plant.

Nicotine derived from tobacco contains the highest concentration of the substance in any natural plant source. Even though synthetic nicotine now exists, any product containing nicotine—whether from tobacco or synthetic sources—falls under TPD regulations.

This means all vaping products sold in the UK must comply with the same strict standards as traditional tobacco products, ensuring consumer safety and quality control.

When Did TPD Come Into Effect?

The TPD was established in May 2014 and became legally binding on 20th May 2016. This gave retailers time to sell off any remaining non-compliant stock before the deadline.

Since 2016, all vaping products sold in the UK must be TPD compliant. Any retailers selling non-compliant products are breaking the law and putting customers at risk.

TPD Rules for E-Cigarettes and E-Liquids

As of May 2016, any nicotine-containing vaping product sold in the UK must comply with these specific rules:

E-Liquid Containers

  • Maximum volume: Single bottles cannot exceed 10ml of nicotine-containing e-liquid
  • Nicotine strength: E-liquids cannot exceed 20mg/ml nicotine concentration
  • Packaging: Must be child-resistant and tamper-evident
  • No filling: Containers must be completely sealed—refilling is not permitted

E-Cigarette Tanks

  • Maximum capacity: E-cigarette tanks cannot hold more than 2ml of e-liquid
  • Design: Tanks must be designed to prevent leakage
  • Safety features: All electrical components must be safe and reliable

E-Liquid Ingredients

All e-liquids sold must contain only approved ingredients:

  • Propylene Glycol (PG) – Carrier base
  • Vegetable Glycerine (VG) – Carrier base
  • Pharmaceutical-grade Nicotine – The active ingredient
  • De-ionised Water – To dilute the liquid
  • Natural and Artificial Flavourings – Only approved food-grade flavourings

Banned Ingredients:

E-liquids cannot contain:

  • Caffeine
  • Taurine
  • Colourings or dyes
  • Diacetyl (a harmful chemical linked to lung damage)
  • Acetyl Propionyl (similar substance to Diacetyl)
  • Any other harmful additives

Packaging and Labelling Requirements

All vaping products must have:

  • Child-resistant packaging – Designed to prevent children from opening it
  • Tamper-evident seals – So customers know the product hasn’t been opened
  • Warning labels – Clear health warnings about nicotine addiction
  • Ingredient lists – Full disclosure of what’s in the product
  • Nicotine strength labeling – Clearly displayed on the bottle

Synthetic vs. Tobacco-Derived Nicotine

While most e-liquids contain nicotine extracted from tobacco plants, some newer products use synthetic nicotine (lab-created nicotine with a similar chemical structure).

Both types are covered by TPD regulations. Whether derived from tobacco or synthesised in a laboratory, any nicotine-containing vaping product must still comply with all TPD requirements.
